Terms of Service

1. Acceptance of terms
By creating a workspace or using The Tech Pad (“the Service”), you agree to these Terms of Service (“Terms”). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Service.
2. The Service
The Service provides a team workspace for WhatsApp Business including a shared inbox, contacts and audiences, campaign and template management, WhatsApp number onboarding, team management, analytics, an API, outbound webhooks, and optional AI assistance and integrations.
WhatsApp messaging is powered by the Meta Cloud API. Your use of WhatsApp is also governed by Meta’s own terms, policies and messaging requirements, which may change from time to time.
3. Accounts and workspaces
- You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity under your account.
- A workspace is owned by the account that creates it. Workspace owners can manage members, roles and settings.
- You may not share API keys or credentials outside your organization, or resell access to the Service without our written consent.
4. Your WhatsApp numbers
- You connect WhatsApp Business numbers you own or are authorized to use. You are responsible for those numbers and for complying with WhatsApp’s Business Messaging Policies.
- Number onboarding uses Meta’s Embedded Signup flow. Connection status and Business Profile details come from Meta.
- You must obtain all consents required by law and by Meta before messaging customers, including for campaigns and AI-generated content.
5. Acceptable use
You agree not to use the Service to:
- send unsolicited, spam or misleading messages, or message people without required consent;
- violate WhatsApp, Meta or applicable law (including India’s IT Act, the DPDP Act 2023, and consumer-protection rules);
- distribute malware, phishing content or unlawful material;
- interfere with, disrupt or attempt unauthorized access to the Service, Meta’s APIs or any connected system;
- reverse engineer the Service except as permitted by law.
6. Plans, billing and payments
- New workspaces receive a free trial period (currently 30 days).
- Paid plans are billed monthly or yearly in advance. Yearly billing includes two months free relative to monthly pricing.
- Plan limits (messages, campaigns, API calls, numbers, members) are described on the pricing page. Over-limit messages remain queued until you upgrade or your quota resets.
- Meta WhatsApp messaging charges are separate from your Tech Pad subscription and are billed according to Meta’s pricing.
- Refunds are provided only where required by law or at our discretion. You can cancel anytime; access continues until the end of the paid period.
7. AI features
- AI assistance (Draft Reply, Summarize, Copilot, Auto-Pilot) generates suggestions based on your conversations and knowledge base. Suggestions are unedited content — you review and approve before sending.
- You are responsible for the accuracy, lawfulness and consent requirements of any message sent, including AI-generated content.
- When AI is enabled, relevant conversation content is sent to the AI provider configured for your workspace (e.g. DeepSeek, OpenAI, Anthropic). Keys are stored server-side.
8. Integrations
Integrations such as Shopify connect your workspace to third-party services you choose. Those services have their own terms and privacy policies. We are not responsible for third-party services, but we process data on your behalf as described in our Privacy Policy.
9. Intellectual property
We own the Service, its software, design and branding. You retain all rights to your data — your conversations, contacts, templates and content. You grant us the limited rights needed to operate the Service (for example, to deliver messages via Meta and process data through subprocessors).
10. Availability and disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied. We do not guarantee uninterrupted availability — WhatsApp delivery depends on Meta, and uptime may be affected by maintenance, outages or third-party services.
11. Limitation of liability
To the maximum extent permitted by law, our total liability arising from the Service is limited to the amount you paid us in the three months preceding the claim. We are not liable for indirect, incidental, consequential or punitive damages, lost profits, or loss of data.
12. Termination
You may delete your workspace at any time from workspace settings (see Data deletion). We may suspend or terminate access for violation of these Terms, abuse of Meta’s APIs, or non-payment. On termination, your data is deleted in line with our Privacy Policy and applicable law.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified in the Service or by email to the address on your account. Continued use after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the competent courts in India.
